Terms of Service

These Terms of Service (the “Terms”) govern your use of Brevva, a service operated by SFZ Labs (“Brevva”, “we”, “us”). By creating an account or using the service you agree to these Terms. If you do not agree, do not use Brevva.
1. The service
Brevva is a software-as-a-service product for monitoring and analyzing usage of large-language-model (LLM) APIs. We capture usage metadata (token counts, latency, error category, cost estimates) from providers you connect, present analytics dashboards, and optionally proxy your API requests. The exact feature set depends on your subscription plan and may change over time.
2. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding contract. You agree to provide accurate registration information and a valid email address; we will send a verification link before granting full access. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, including activity by team members you invite.
3. Subscription plans, fees, and billing
Brevva offers a free tier and paid plans (currently Builder and Studio). Paid plans are billed monthly in advance via Stripe. Prices and feature inclusions are listed on our pricing page and may change with prospective notice.
- Auto-renewal. Paid plans renew automatically each month until cancelled.
- Upgrades take effect immediately, with prorated billing where Stripe supports it.
- Downgrades and cancellations enter a 30-day grace period during which paid features remain available; at the end of the grace period the plan transitions to Free. We do not refund partial months.
- Failed payments. If Stripe is unable to collect payment we will retry on Stripe’s standard schedule and notify you by email; access may be suspended after repeated failures.
- Taxes. Listed prices are exclusive of VAT, GST, and similar transaction taxes; you are responsible for any such taxes applicable to your purchase.
4. Provider API keys and your responsibility for upstream terms
Brevva is an intermediary between you and third-party AI providers (currently OpenAI, Anthropic, OpenRouter, Google Gemini, Mistral, and Cohere; the list may evolve). To use proxy or sync features you supply your own provider API keys, which we store encrypted at rest using Fernet (AES-128-CBC + HMAC-SHA256) with versioned, rotatable keys.
You remain responsible for compliance with each provider’s terms of service and acceptable-use policies. We do not validate your usage against provider terms, and we are not responsible for actions providers take against your account (rate limiting, suspension, billing disputes). If a provider revokes a key you supplied us, the corresponding Brevva features will stop working until you replace it.
5. Acceptable use
You agree not to:
- use Brevva to violate any applicable law or third-party right;
- use Brevva to circumvent rate limits, billing controls, or other restrictions imposed by AI providers;
- attempt to reverse-engineer, probe, scan, exploit, or disrupt the service or its underlying infrastructure;
- share, resell, or sublicense your account, or use Brevva on behalf of another organization without that organization’s authorization;
- submit content that is unlawful, defamatory, or that infringes intellectual-property rights.
We may investigate suspected violations and, where warranted, suspend or terminate offending accounts. Where practicable we will notify you first.
6. Your data and what we do with it
You retain ownership of all data you submit to or generate via Brevva. We process your data solely to provide the service, as described in our Privacy Policy. We do not train AI models on your data, and we do not sell your data. Brevva captures only metadata about your API calls — model name, token counts, latency, error class, cost estimate. Prompt and response bodies are forwarded to the provider untouched and never persisted.
7. Aggregate benchmarks (opt-in)
Brevva publishes anonymized aggregate benchmarks (median model latency, error rates, cost per 1k tokens) using data from accounts that opt in. We apply k-anonymity: a metric is published only when at least 50 distinct accounts have contributed data for it. You can opt out at any time from your Settings page. Opting out applies prospectively and excludes future contributions; it does not retroactively delete already-published aggregates, which by design cannot be linked back to you.
8. Service availability
We work to keep Brevva available but do not guarantee any specific uptime under these Terms (an SLA is available on Studio with separate commitments). The service depends on third-party infrastructure (Railway, Vercel, Stripe) and on the AI providers you connect; outages or breaking changes by those providers will affect Brevva. We are not liable for unavailability, rate-limit changes, model deprecations, or pricing changes outside our control.
9. Termination, account deletion, and data export
- You may delete your account at any time from your Settings page. Deletion is immediate and removes your provider connections, api-call logs, and personal data. Audit-log records of security-relevant actions are retained for one year for incident investigation, after which they are pruned automatically.
- We may suspend or terminate accounts for material violations of these Terms, suspected fraud, repeated failed payment, or activity that risks the integrity of the service or other users. Where practical we will give notice and an opportunity to cure.
- Data export. While your account is active, you may export usage data via the dashboard (CSV export is on Studio). On deletion, we do not retain exports for you; please export anything you need first.
10. Intellectual property
Brevva, including its codebase, design, documentation, and aggregate benchmarks, is owned by SFZ Labs and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the service for its intended purpose during the term of your subscription. No other rights are granted.
If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use that feedback to improve the service, without obligation to you.
11. Disclaimers
Brevva is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that Brevva will be uninterrupted, error-free, or that the analytics it presents are complete or accurate (cost estimates and error classifications are best-effort).
12. Limitation of liability
To the maximum extent permitted by law, neither Brevva nor SFZ Labs is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or related to these Terms is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not permit the exclusion of certain warranties or limitation of liability, in which case these limitations apply only to the extent permitted.
13. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, and reasonable legal fees arising from (i) your use of Brevva, (ii) your violation of these Terms, or (iii) your violation of any third-party right (including AI provider terms of service).
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The parties agree to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware for any dispute that is not otherwise subject to mandatory arbitration under applicable law.
15. Changes to these Terms
We may revise these Terms from time to time. Material changes will be communicated by email and/or in-product notice at least 30 days before they take effect, except for changes required by law or to address an urgent security risk. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
16. Miscellaneous
- Entire agreement. These Terms, the Privacy Policy, and any order form or DPA executed between us constitute the entire agreement and supersede prior agreements on the same subject matter.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or reorganization.
